These Terms of Service ("Terms") govern your access to and use of EK Diary, the personal diary, journal, planner and habit‑tracking service available at ekdiary.com (the "Service"), operated by EK Diary ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian.
You are responsible for maintaining the confidentiality of your account credentials and Vault PIN, and for all activity that occurs under your account. Notify us immediately at yourekdiary@gmail.com if you suspect unauthorized access to your account.
You retain full ownership of the diary entries, journal content, planner data, photos, and other material you create or upload ("Your Content"). By using the Service, you grant EK Diary a limited, non‑exclusive licence to store, process, back up, and display Your Content solely for the purpose of operating and providing the Service to you (including features you activate, such as AI assistance or PDF export). We do not claim ownership of Your Content and will not use it for purposes unrelated to providing the Service, such as training third‑party AI models on your private entries.
You are solely responsible for Your Content and confirm that you have the right to store and upload it, and that it does not violate any law or infringe the rights of any third party.

EK Diary offers a free tier and a paid Premium tier, as well as an in‑app Store where you may purchase digital coins, premium themes, and physical merchandise using Indian Rupees (₹) via our payment partner, Razorpay. Pricing, features included in each tier, and available products are shown in the app and may change from time to time. Purchases are subject to our Refund & Cancellation Policy and, for physical goods, our Shipping Policy.
Coins have no cash value, cannot be exchanged for money, and are non‑transferable between accounts except where explicitly permitted in‑app.
Optional AI‑powered features (such as the AI planning assistant) are provided for informational and productivity purposes only. AI‑generated suggestions may be inaccurate or incomplete and should not be relied upon as professional, medical, financial, or legal advice. You are responsible for evaluating any AI‑generated content before acting on it.
The Service, including its name, logo, design, themes, and underlying software, is the property of EK Diary and its licensors and is protected by intellectual property laws. Except for the limited right to use the Service as intended, these Terms do not grant you any rights to our trademarks, branding, or source code.
The Service relies on third‑party providers, including Firebase/Google Cloud (hosting and storage), Vercel Blob (file storage), Google Analytics and Google AdSense (analytics and ads), Razorpay (payments), and Groq (AI processing). Your use of features backed by these providers is also subject to their respective terms, to the extent applicable.
You may stop using the Service and request account deletion at any time by contacting yourekdiary@gmail.com. We may suspend or terminate your access if you violate these Terms, engage in fraudulent or abusive behaviour, or if required by law. Upon termination, your right to use the Service ceases, though certain provisions of these Terms (e.g. limitation of liability, governing law) will survive.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Service will be uninterrupted, error‑free, or completely secure.
To the maximum extent permitted by law, EK Diary shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim relating to the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.
You agree to indemnify and hold EK Diary harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Service.
These Terms are governed by the laws of India, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of India.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
